• Australia’s High Court is hearing constitutional challenges to its nationwide social media ban for children under 16, with opponents arguing the restrictions violate protections for political communication.
• Reddit and the Digital Freedom Project contend that the law unnecessarily restricts young Australians’ freedom of expression, while the government maintains the restrictions protect children from online harm.
• Despite millions of accounts being deactivated, substantial numbers of underage users reportedly continue accessing restricted platforms, raising questions about enforcement, effectiveness and government overreach.
Australia’s High Court began hearing constitutional challenges Tuesday to the country’s ban on social media accounts for children younger than 16. The Digital Freedom Project and Reddit argue the restrictions improperly burden the implied freedom of political communication, limiting teenagers’ ability to debate public issues and participate in civic life. The law, effective since December 2025, covers 10 major platforms, including YouTube, TikTok, Instagram and Reddit.
Government lawyers contend the restrictions protect children from addictive platform features and other online harms, and that any limits on political communication are justified. Reddit also disputes its classification as a restricted social media platform. Authorities report millions of accounts have been removed or deactivated, but research indicates many underage users continue accessing social media. The government has strengthened enforcement powers and raised the maximum penalty for platform noncompliance to 99 million Australian dollars. The seven-judge court is hearing arguments across two days.
Why It Matters
The case raises a question extending beyond Australia: How far may government go in protecting children before it assumes responsibilities traditionally exercised by parents and restricts expression? Protecting minors from exploitation, addictive design and harmful content is a valid public concern. Yet a sweeping account ban also removes lawful avenues for young people to exchange ideas, follow government decisions and engage in political debate.
The constitutional dispute could establish limits on government authority over digital communication. Evidence that teenagers continue using restricted platforms also challenges whether broad prohibitions deliver meaningful protection or simply encourage workarounds. More targeted safeguards, parental control and accountability for harmful platform features deserve consideration alongside age restrictions. For other democracies weighing similar laws, the court’s eventual ruling may help determine whether child safety policies can withstand scrutiny when they limit speech. Effective protection should not require government to treat every young person’s online participation as a danger.
