      Uber Held Liable in $40 Million Award After Passenger’s Freeway Death

      A $40 million arbitration award against Uber is raising consequential questions about the responsibilities rideshare companies bear for passenger safety and the conduct of drivers operating through their platforms. Retired California Judge Richard A. Stone found Uber and driver Vu Tran jointly liable for the death of 23-year-old Emily Normandin-Parker, who was struck and killed on State Route 73 in Orange County in August 2023 after Tran stopped at a freeway gore point and left Normandin-Parker and her friend, Luna Moore, there following a dispute involving a cleaning fee. Stone rejected Uber’s contention that its status as a technology platform and its drivers’ independent-contractor classification insulated the company from liability, concluding instead that Uber functions as a common carrier with a duty to protect passengers. The decision awarded Normandin-Parker’s parents $20 million each, while Moore received $300,000.

      A $40 million arbitration award against Uber has put renewed attention on a basic question surrounding the rideshare economy: When customers purchase transportation through a company’s platform, how much responsibility does that company bear for getting them safely to their destination?

      Emily Normandin-Parker, 23, and friend Luna Moore ordered an Uber after a night out in August 2023. After Moore became sick during the trip, driver Vu Tran stopped at a gore point along California State Route 73. A dispute over a cleaning fee followed, and the women were left beside the freeway. Normandin-Parker, who was intoxicated, subsequently entered traffic and was fatally struck.

      Retired Judge Richard A. Stone, acting as arbitrator, determined that Tran acted negligently and that Uber could also be held responsible. Critically, Stone rejected Uber’s position that Proposition 22 and Tran’s independent-contractor classification insulated the company from vicarious liability. The ruling characterized Uber as effectively providing transportation services rather than functioning merely as a neutral technology intermediary.

      That distinction reaches beyond one tragic case. The rideshare business model has long depended upon treating drivers as independent contractors while the companies control important elements of the transaction, including fares, access to customers and platform rules. Stone’s reasoning suggests companies cannot necessarily claim extensive control over a transportation marketplace while simultaneously disclaiming responsibility when transportation goes catastrophically wrong.

      Uber disputes the liability determination and has emphasized safety improvements. The award nevertheless reinforces an old principle in a modern marketplace: technological innovation does not automatically eliminate accountability. When consumers entrust a company with their transportation, courts and arbitrators may increasingly examine the substance of that relationship rather than the contractual labels companies attach to it.
