      A North Carolina musician has been sentenced to 18 months in federal prison for orchestrating an elaborate artificial intelligence-driven music streaming fraud that generated more than $8 million in illicit royalties. Michael Smith, 54, exploited major streaming platforms, including Spotify, Apple Music, Amazon Music, and YouTube Music, by distributing hundreds of thousands of AI-generated songs and using thousands of automated accounts to manufacture billions of fraudulent plays between 2017 and 2024. Smith pleaded guilty to conspiracy to commit wire fraud in March 2026 and was sentenced on October 6, marking the conclusion of the Justice Department’s first criminal prosecution involving AI-assisted music streaming fraud.       Smith pleaded guilty in March 2026 and subsequently received an 18-month prison sentence, two years of supervised release, and an $8.09 million forfeiture order.

      The case illustrates a fundamental distinction between legitimate technological innovation and deliberate financial deception. Artificial intelligence can expand creative opportunities, but its use to manufacture fictitious consumer demand constitutes fraud.
